"48 HOURS" INVESTIGATES IN "PLAYING BY THE RULES?"

A popular Texas football coach has spent the last eight years in prison for murdering his pregnant wife, but was evidence hidden from the defense that could make him a free man today? Richard Schlesinger and 48 HOURS investigate the case against David Mark Temple, in "Playing by the Rules?" to be broadcast Saturday, March 12 (10:00 PM, ET/PT) on the CBS Television Network.
It's a case 48 HOURS has been covering for nine years, and now dramatic new developments may change Temple's fate.
"I've known since day one that this day would come," Temple tells 48 HOURS. "And we're getting close to the end, I know."
Temple, a former football star and coach, was convicted in 2007 for the 1999 murder of his wife. The trial pitted two of the biggest names in the legal world against each other: renowned defense attorney Dick DeGuerin, who successfully defended billionaire Robert Durst, and legendary prosecutor Kelly Siegler, who now stars in her own TV show. At trial, prosecutors maintained Temple was having an affair and wanted his wife out of the picture, while DeGuerin suggested Belinda Temple was killed in a burglary gone bad.
"David Temple was convicted after a six week trial by a fair and impartial jury for executing his wife and unborn child," Siegler tells 48 HOURS. "He was given a life sentence. He's sitting behind bars. And that's where he deserves to be."
But Temple's new attorneys, Stan Schneider and Casie Gotro, allege that Siegler withheld crucial evidence from the defense. "She lied, she cheated, and she broke the rules," Gotro tells 48 HOURS.
Siegler insists she followed the law. She says Temple's trial attorney got everything he was entitled to get, when he was entitled to get it. "Eventually, everybody's going to understand that the truth is what happened in that courtroom, and it's all going to be over with."
Will it? Last July, a Texas judge recommended that Temple get a new trial. Now it's up to the Texas Court of Criminal Appeals to make the final call. Will Temple get another shot at freedom, or will he spend the rest of his life in prison?
